Understand the agreement before you commit.

A condo assignment can offer flexibility, but the details depend on the original purchase agreement, builder policies and the parties’ legal and financial circumstances.

What is a condo assignment?

It generally means the original buyer (assignor) transfers their contractual interest in a pre-construction purchase agreement to a new buyer (assignee) before the original purchase closes. It is not the same as transferring registered title to a completed home.

Who might it suit?

It may suit an original buyer who needs to exit before closing, or a buyer seeking a particular pre-construction unit. Each party should assess the contract, timeline, funds required, financing and tax implications with their own lawyer and tax professional.

What does the process involve?

Review the original agreement and assignment restrictions; confirm builder consent, fees and deadlines; negotiate and sign the assignment agreement; satisfy deposit and review conditions; arrange financing and legal/tax advice; and coordinate assignment closing and the builder’s final closing requirements.

What are the main risks?

Builder consent may be restricted or refused; fees, development charges, HST or income-tax issues may apply; financing or appraisal may fall short; deadlines can be tight; and a party may remain liable under the original agreement. Costs and tax treatment depend on the facts—get independent legal and tax advice.

General information only, not legal, tax, mortgage or investment advice. Assignment rights, consent requirements, fees and closing obligations vary by contract and project. Have your lawyer review the specific documents before you make a commitment.
